Question:

Dear Attorney,

I have received on consignment from a customer a ceramic vessel but, because of my accidental impact, has suffered a crack.

I promptly alerted the rightful owner, tranquillizzandolo that the cost for repair is, of course, entirely against me, but the gentleman says that being irreparably damaged, the vessel no longer has the same value and expect me to buy him at the price that would not have suffered the damage.

Premise that the value of an object of that species, intact and without damage, is approximately E. 300.00 and then I have no problem paying them, but I ask the owner if indeed he is right in "straight" or "we're doing the ridge." Thank you.

Answer:

Dear reader,

You are required to pay damages, but rather to "nature" of the obligation for compensation, this constitutes a "debt value", where the intended purpose is to restore the heritage of the injured party in a situation where this would have been if had not occurred the harmful event (damage to the vessel, in this case).

Accordingly, it is at the discretion of the owner of the claim, alternately, in pristine or refurbishing / repair of the goods with a total expenditure borne by the person who committed the damage, or the payment of the price attributed to the object before damage.
